2. Who We Are and What We Make

BeauMarshal, LLC is a software development company based in Newport Beach, California. We build and operate several products:

  • 44 — A developer API for integrating audio capabilities into any application.
  • FlipBridge — How busy parents make time to connect.
  • Suitcase — Sell trips and experiences from one beautiful, bookable page.
  • MotoDossier — A mobile app for motorcycle enthusiasts to track maintenance, document rides, and manage their collection.

These Terms apply to all of the above products and any future products we build. We reserve the right to modify, suspend, or discontinue any part of our Services at any time.

3. User Accounts

Some of our Services may require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Subscriptions

If you purchase any paid features or subscriptions:

  • You agree to pay all fees associated with your purchase
  • Payments are processed securely through our authorized payment processor, who acts as the merchant of record for our transactions and handles payment routing, tax collection, compliance, and invoicing on our behalf
  • Subscription fees are billed in advance on a recurring basis
  • You may cancel your subscription at any time through your account settings or by contacting us
  • Charges on your bank or credit card statement may appear under the name of our payment processor rather than BeauMarshal

5. Refunds

We offer a 30-day, no-questions-asked refund on all subscriptions. Full details are in our Refund Policy.

6. Intellectual Property

All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, software, and code—are the exclusive property of BeauMarshal, LLC and are protected by copyright, trademark, and other intellectual property laws.

7. User Content

You retain ownership of any content you submit through our Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing our Services to you.

8. Prohibited Conduct

You agree not to:

  • Use our Services for any illegal purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our Services

  • Not use the APIs to build a product that competes directly with our Services

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, BeauMarshal, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services. Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BeauMarshal, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our Services or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. When changes are significant, we will make reasonable efforts to notify you via email or through the product. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
